The case of See v. Seattle was based on the issue of whether or not the Washington State Constitution guaranteed homeless people the right to sleep outside if there were no available shelter options. The lawsuit was brought by eight individuals, who identified as homeless and had been cited numerous times for sleeping in public spaces due to a lack of affordable housing or other resources (Gudmunson et al., 2019). After hearing testimony from multiple experts, including representatives from both sides, Judge Andrus ruled that “there is undoubtedly a serious shortage in affordable housing” (Gudmunson et al., 2019). As such, he reasoned that criminalizing homelessness would place an undue burden on those already facing extreme hardship with no real solution for addressing their needs. Consequently, Judge Andrus determined that it violated the Washington State Constitution’s protections regarding public rights and privileges and ordered Seattle to stop punishing people for sleeping in public spaces when no shelter space was available (Gudmunson et al., 2019). In essence, this decision represented a landmark victory for homeless individuals faced with discrimination and unfair treatment while also providing increased protection against criminalization of poverty-related activities such as sleeping outdoors without adequate alternative accommodations.
