Judicial power can have a very significant effect on policy making in American politics, especially when the federal courts reinterpret the law or the Constitution. Supreme Court decisions are especially important in that they become the “law of the land” for the whole country.

Choose a Supreme Court case from any chapter in your text in which the court’s decision created or changed a policy or previous law in the United States. Give the name and date. In the discussion, identify your chosen case and explain whether you agree or disagree with this decision. Be sure to provide rationale for your response.

 

My chosen Supreme Court case is District of Columbia v. Heller (2008). This case sought to answer the question of whether or not the Second Amendment provides individuals with an individual right to own a firearm. The court sided with Heller and declared that it does indeed guarantee this right which in turn allows citizens to keep firearms in their home for self-defense purposes.

I agree with this decision as I believe it upholds an essential liberty as outlined by our Founding Fathers. The Second Amendment gives all citizens the right to bear arms regardless of what state or jurisdiction they live in, therefore making sure that everyone has access to firearms for protection (Heller 2008). Furthermore, this ruling also takes into consideration the need for rational regulation on guns without infringing upon someone\’s ability to defend themselves when needed (Heller 2008). Thus while certain restrictions are necessary, total bans on gun ownership should be off limits due protected nature of such rights(Heller 2008)

Additionally, I believe that providing individuals with an individual right to own a firearm helps prevent governments from becoming tyrannical by ensuring people have means protect themselves against oppressive forces (Heller 2008). This is especially true given American’s history which includes military coups and other forms of government takeover attempts throughout its past.(CITATION) As long as proper regulations are put in place ,gun ownership can help ensure some level of public safety while also protecting citizens from any potential overreach by those in power.

In sum then, I support the Supreme Court’s decision made in District Of Columbia V. Heller as it strikes balance between allowing gun ownership for self-defense purposes yet still providing responsible regulation so far curtailing unnecessary misuse or accidental shootings.
