Case Study 1: Legal Documents
As a healthcare professional, you will work with patients and some of them will need instructions on how to create a Last Will & Testament, Advanced Directives, & Power of Attorney (for both Finances/Property and Health). Although your role as a future healthcare professional will never take the place of a licensed and qualified attorney, you should understand the processes involved in all these important documents so you can not only be prepared to guide patients when applicable, but also so that you individually are prepared.
I. Please describe, in detail, the similarities and differences of each of the aforementioned documents bolded above using the plethora of information available on the internet. Provide a well-thought-out template of how you would write your own documents (provide no personal information, please – just a template/outline of the information you would need to complete all the bolded items above).
II. Talk to 5 people in an informal “interview”. Ask them about the preparation of their own documents as bolded above. Were they knowledgeable of the documents; were you able to help define and clarify the similarities and differences between the documents; were you surprised of who was prepared and who was not??? Go beyond these questions to provide a paragraph/ summary of each person you interviewed being sure not to mention any names or highly personal information.

A last will and testament, advanced directives, and power of attorney are estate planning documents that operate under different circumstances. Both forms offer peace of mind to your loved ones; however, they do not replace one another. A last will and testament is a legal document where you leave instructions and express your wishes for your property when you die. A power of attorney is a legal document giving someone you name (your agent) the authority to act on your behalf. Power of attorney documents only govern when you are alive. An advance directive is a legal document that outlines your healthcare wishes if you become incapacitated. They apply in cases of injury, illness, or a permanent vegetative state.
