Police and the Rule of Law

In our Chapter 6 reading, we learned about the different issues that law enforcement agents face, especially when apprehending individuals and collecting evidence. For example, some evidence may be inadmissible in court if the evidence were obtained illegally or are classified as an exception to the warrant requirement. This is to protect the suspected person per due process.
Based on the material from lecture and reading, define “probable cause” and give an example in which an officer may conclude that probable cause exists.
In addition, explain and identify two of the six exceptions to the warrant requirement officers must adhere by, and provide an example for each. Be sure that you: 1) explain your two exceptions, and 2) provide an example for each exception outlined. This is important especially when distinguishing the exceptions from one another.

Sample Solution

  • Violence: Law enforcement agents are often exposed to violence, both physical and verbal. This can take a toll on their mental and emotional health.
  • Trauma: Law enforcement agents often witness traumatic events, such as deaths, shootings, and assaults. This can lead to post-traumatic stress disorder (PTSD) and other mental health problems.
  • Stress: Law enforcement agents are often under a great deal of stress. This can be due to the nature of their work, the long hours, and the constant threat of danger.
  • Isolation: Law enforcement agents can often feel isolated from their families and friends. This is because they often work long hours and have to deal with difficult situations that their loved ones may not understand.
  • Burnout: Law enforcement agents are at risk of burnout, which is a state of physical, emotional, and mental exhaustion. Burnout can lead to a number of problems, including decreased job performance, increased absenteeism, and substance abuse.
  • Discrimination: Law enforcement agents may face discrimination based on their race, gender, or sexual orientation. This can make it difficult for them to do their jobs and can lead to feelings of isolation and resentment.
  • Lack of support: Law enforcement agents may not receive the support they need from their supervisors or from the public. This can make it difficult for them to cope with the stress of their jobs and can lead to feelings of frustration and anger.

These are just some of the issues that law enforcement agents face. It is important to be aware of these issues so that we can support law enforcement officers and help them to do their jobs safely and effectively.
