Voluntary and involuntary confessions are two distinct types of evidence that can be used in legal proceedings. A voluntary confession is a statement given by an accused without any form of coercion or duress, while an involuntary confession is one given under duress or against their will (ABA 2018). The distinction between these two concepts was important to the 1966 Miranda decision which established the Miranda Rights for suspects as they were being interrogated.

A voluntary confession must be freely given with full knowledge of the consequences associated with it. The court determined that since he had not been read his rights prior to questioning ,the resulting confession could not be seen as voluntary because he was unawareof his rights under the fifth amendment .
